Split infinitives

Is it permisible to split the infinitive?

eg:
1) To pursue ardently
2) To ardently pursue


Which of the following sentences is right ?
1) The agency is required to either approve the plan or enforce one of their own.
2) The agency is required either to approve the plan or to enforce one of their own.

In the real world? Yes. On this test? No. So in this case - "either to approve... or to enforce..."

(Note: pronoun error alert! Agency is singular. It cannot enforce one of "their" own. :)
