Why not D? Is it because the term disputants was used? please explain. What about B and A?Thanks.

Here, the author is arguing that "despite the 'accommodating' nature of the judicial system...the power of the Supreme Court has been exercised in a manner that has usually been beneficial to Native Americans." She offers two examples to support this view (paragraphs 3 and 4). So we want to look for an answer that provides a clear opinion; the author isn't just presenting various views or attacking a view. She's endorsing the one she favors and supporting it.

This is why answers (A)-(D) are wrong: we can scan them and more or less eliminate just based on the verbs alone! (E) suits our prediction.

I'm trying to highlight here the value of prephrasing your answer. It not only helps guide you to the right answer, it can also help you quickly eliminate wrong ones.
