That's part of it - a red flag at the very least. But the real reason is that "system of rules" and "universally adaptable" actually describe the way that the author thinks common law should NOT be seen. It's not a system of rules, but a narrative.

See lines 21-26, 32-34, 44-50.

After reading the passage, you should see that the word "history" is pretty much essential to any description of the main point (lines 12-15).
